would I be able to volunteer with a dismissed theft charge on my record? It's nolle prosequi so I'm in the process of getting it expunged now but that takes 3 months and I want to volunteer now. Besides that my record is clean.

i thought i already answered this + it'll take longer then 3 months(in nys anyway). You still have all of the below left. CPL §160.55(c)--- Criminal procedure law
Decline To File Accusatory Instrument (By The Police)
Order Setting Aside The Verdict
Order Vacating The Judgment
Habeas Corpus

You should check with the agency that you plan to volunteer with. They are the only ones who can give you a definite answer.

Only the agency you want to volunteer at can tell you if you meet their standards or not. Not to purposefully sound like an a**, but you'll get better results calling them and asking, especially when we don't even know which state you're talking about, and everyone has different standards.

I'm not familiar with that term, "dismissed theft charge on my record." Was the charge dismissed? were you convicted and found guilty? if the charge was dismissed, why is it on your record? what state is this in?

why are you in such a rush? while I am completely in favor of being eager and starting as soon as possible, waiting 3 months isn't going to kill you.

I wasn't found guilty/convincted. It's dismissed but the charge still shows up on my record.

Odd.... I always thought you were innocent until proven guilty. Learn something new every day,

If that showed up on my record, and someone asked me about it, I would calmly say "yes, I was arrested, yes I was charged, and when I had my day in court, it was quite obvious that they arrested the wrong person, and the charges were dismissed."

Just because a charge was dismissed doesn't mean it won't show up. There will still be an arrest record. I had to do backflips for the state of Texas to give me my cert over a DUI charge from 7 years ago that was thrown out. Pain in my ***.
