You guys don't have to jump all over me. I made a mistake and was taught wrong regarding the protocols for our forms, and I'm going to speak with those who told me this.
Does your agency allow non-certified members to do refusals? Cause that seems like a poor idea.

This is why formal training is so important. Refusals aren't really touched to much in class, but the brief medicolegal primer will give you some insight as to what you need to accomplish.

OK, I suppose he could have got it wrong, maybe is inexperienced, but did no one, even his partner, who was present, clue him in?

I get the feeling that this problem is higher up than the OP. Probably his partner and/or FTOs told him "this is how we do things", and the cops are doing it and they're supposed to know the laws... Easy to not question something if everyone is doing it. Amazing that they haven't had the pants sued off them yet, though.
