Hospital refusing patient?

This cannot be determined until the patient has had an MSE done by someone qualified to perform the MSE.

So, I imagine this varies by state? Does it have to be a physician? Can it be, say, a fast-track ED NP or PA?

Ideally this is done by a physician but a PA or NP can do it. Hospital policy will basically drive this but generally speaking, if the person can prescribe, the person has sufficient education and license necessary to do the MSE. Typically the ED Triage nurse doesn't have this ability to do the MSE, nor do the bedside nurses.

I'm a Security Officer at a large hospital and we trespass people quit often. The trespass is good for one year but they can still return to the hospital in the ED and be seen if they are claiming to have a medical or psych condition. After they are seen and if it determined there is nothing wrong they are escorted off property.

Akulahawk touched base on all of that but figured I would give my two cents.
