Emancipated Minor

What is the true definition of an emancipated minor? Recently transported a 16 y/o pregnant girl. Upon arrival to the ED I assumed that she was a minor and asked for the receiving RN's signature. She asked why, stating that she was an emancipated minor because she was pregnant and could sign on her own. I was under the impression that to be emancipated you have to seek legal action to get this status. Is this true or does it vary from state to state?

Depends on the state. I'd be asking for paperwork (pregnant or not) for anyone claiming to be emancipated.

Yeah paperwork would be good...but what the nurse was claiming was just because of the fact that she was pregnant, she was automatically emancipated..in the nurses words, "As soon as they have the bump, they are emancipated"

I'm not sure what your state's take on it is, but here in MO being pregnant doesn't automatically make you emancipated. So, in your case, I would of had the nurse sign anyway.

Here, if you're pregnant or have ever been pregnant, regardless of age, you're able to make decisions for yourself.

In Texas, a minor can consent to treatments if;

Active duty military
Emancipated (have shown responsibility for themselves and do not live with parents)
With a reportable communicable disease
With an addiction to drugs
In regards to suicide prevention, abuse or addiction

If pregnant, they can consent to treatment of pregnancy (NOT abortion) - they are not however, emancipated.

Emancipated minor can also mean "dumped by parents"
