Duty to act?

Does a person who is licensed as a paramedic in a state (Nevada in this case) is employed by an ALS/transport providing fire department, but who is not compensated at the paramedic level (by choice) have a duty to provide ALS level care on the scene while on duty?

Thoughts?

The question read as quoted, Vent. I answered what I know with the information provided in the question. No other scenario was given. He asked if he was obligated even if he "chose" to be paid at a lower level. The answer is yes, there may be some responsibility if the department pays for anything related to maintaining a higher level.

Yes, it was quoted as "by choice". Our FFs can rotate off as primary medic "by choice" after they have a couple years of senority to a ladder or engine that only does BLS if any medical first response at all even if they continue to hold the Paramedic cert and are paid the extra dollars. They are however in no way responsible to function at an ALS level and should NOT do so unless the Medical Director puts them on the list to where they can function as a Paramedic.

Since medics (or any other cert level, hard to keep up with all of them) are authorized to practice medicine only under an MD's license (you're effectively an extension of the OMD), you're scope and duty to act are dictated by the OMD. It would be a good idea to get the straight story from the office of the OMD as to when and where you're required to act, and to what scope under certain circumstances.

I just don't see where the post says unless or but..it simply asked about duty to act.
